Agreement to These Terms

These terms govern the use of the website at haywardliteracyplus.com and the tutoring services delivered from the reading room at 888 C St, Hayward - 94541-5101, United States (US) by HAYWARD LITERACY PLUS COUNCIL. By reading the site, submitting an enquiry or attending a session, a person agrees to the terms set out here. A person who does not agree may still call +19364008891 to ask questions, but should not rely on the website or on attendance as a binding arrangement.

The Council is a nonprofit teaching organisation. These terms are written to be understood by an adult learner, a volunteer tutor, a partner agency and a funder without legal training. Where a provision is unclear, the desk will explain it in plain language on request.

Definitions

In these terms, the Council means HAYWARD LITERACY PLUS COUNCIL, its staff, its volunteer tutors and the reading room it operates at the address above. The website means the pages served at haywardliteracyplus.com and any related pages operated by the Council.

Learner means an adult or older learner who attends sessions at the reading room or receives tutoring arranged through the Council. Tutor means a volunteer or member of staff who delivers tutoring. Partner means an agency, library, school district or funder that refers learners or supports the service.

Session means a scheduled tutoring hour. Service means any of the six teaching undertakings described on the services page, including lesson slips, session logs, learner notes, placement windows, book club review rounds and tutor sittings.

Eligibility and Enrolment

The reading room serves adults and older learners who want help with reading, writing, study or the everyday documents that reading supports. Enrolment begins with a conversation and a placement window. There is no minimum score to enter and no maximum score beyond which a person is turned away.

A learner under the age of eighteen may attend only with the written consent of a parent or guardian and only where the programme has space and a suitable tutor. Family literacy activities are arranged separately and the desk will explain the difference.

The Council may decline an enrolment where the reading room cannot meet a person needs safely or where the request falls outside the service described on this site. In that case the desk will explain the reason and, where possible, suggest another local service. A refusal is not a judgement about the person.

Description of Services

The Council provides adult literacy tutoring delivered at the reading room. The services are held together by a simple method: an hour at a table, a tutor who is prepared, reading material chosen for an adult, and a written record of what happened. A learner can expect the following.

Lesson slips

A short written record after each sitting describing the text, the difficulty and the next step. A learner may ask to see the slip and may ask for a correction.

Session logs

A continuous record across a term. Learners may request a summary at any review point, and staff use the log to check that the pace is right.

Learner notes

A notebook kept by the learner. The notebook belongs to the learner at the end of a term and is not used for any purpose beyond teaching.

Placement windows

A calm first meeting that ends with a practical plan rather than a badge or a level label.

Book club review rounds

A monthly shared reading group. Attendance is voluntary and the group decides which text to read next.

Tutor sittings

Voluntary peer observation that keeps method honest. A learner is asked before any sitting and may decline without giving a reason.

A fuller description of each service appears on the services page. That description forms part of these terms.

Placement and Scheduling

A placement window is arranged by telephone, by email or through a partner referral. The desk will offer the next available window and will say plainly if that date is later than usual. A place is held once confirmed and is released if the learner does not attend and does not make contact within two weeks.

Sessions are scheduled weekly at a fixed hour where possible. A learner may ask to change the hour and the desk will try to accommodate it, but a change depends on tutor availability and is not guaranteed. Sessions take place at the reading room unless the Council has agreed in writing to deliver tutoring at another site.

Attendance and Cancellation

Adults have busy lives and the reading room does not treat a missed week as a failure. A learner who cannot attend should call +19364008891 or write to info@haywardliteracyplus.com as early as possible so the hour can be offered to another learner. Two consecutive missed sessions without contact will lead the desk to pause the place and reach out.

Where a tutor must cancel, the desk will offer a replacement hour or a substitute tutor where possible. If neither is available, the session is not counted against the learner and any materials due are moved to the next meeting.

Sessions that start late begin at the time the learner arrives and still end at the scheduled hour where the room is booked after. The desk will always be honest about this rather than quietly shortening the programme.

Fees and Materials

Many sessions are free because of volunteer time and small grants. Where a fee applies it is small, it is explained before a learner begins, and a person who cannot pay may ask for a waiver without any obligation to explain their finances.

Materials are loaned rather than sold. Books and workbooks remain the property of the Council and should be returned at the end of a term or sooner if a learner leaves. Normal wear is expected and is not charged. A learner who loses a book may replace it or ask for a waiver.

Fees may be adjusted from time to time. Changes are announced in advance at the desk and in the next term plan, and they never apply retroactively to sessions already scheduled.

Learner Responsibilities

A learner agrees to attend sessions honestly, to tell a tutor when material is too hard or too easy, and to treat the reading room and every person in it with respect. A learner agrees not to bring another person into a private sitting without asking first.

A learner agrees not to record a session by audio or video without the agreement of the tutor. A learner agrees to tell the desk about any change in contact details so that the record stays accurate.

The learner remains responsible for their own decisions outside the reading room. Tutoring supports reading and writing; it does not provide legal, medical or financial advice and does not write documents on a learner behalf.

Reading Room Conduct

The reading room is a quiet shared space. Materials borrowed from the shelves are returned to the cart at the end of a visit. No food is eaten at the tables, though a water bottle is welcome. Telephones are kept on silent and a learner who must take a call is asked to step into the hallway.

Harassment of any kind is not tolerated in the reading room, including harassment based on race, gender, religion, disability, age, sexual orientation or immigration status. A person who experiences or witnesses harassment may tell any member of staff and will be believed and supported.

Children are welcome during family activities but may not be left unattended in the reading room while an adult attends a session. The desk can suggest nearby activities.

Tutors and Volunteers

Tutors are volunteers or members of staff who complete a preparation course in adult literacy methods before taking a learner. Volunteers are screened according to the practice for roles that involve working with adults and, where relevant, with young people. References are taken and recorded.

A tutor may not accept payment from a learner for tutoring, may not borrow money from a learner and may not enter a business arrangement with a learner without written approval from the director of teaching. This protects both the learner and the tutor.

Volunteers may stop volunteering at any time. Where a learner has an established situation with a tutor, the desk will arrange a handover so that the learner is not left without support and without explanation.

Records and Learner Notes

The Council keeps teaching records as described in the service section and in the Privacy Policy. The learner may ask to see their own record at any time and may ask for a correction where something is inaccurate.

Records are kept for the period described in the privacy policy and are then destroyed. A learner who wants their record deleted earlier may make a request and will receive a written explanation of what can and cannot be removed.

Learners may keep their own notebooks. The Council may ask to copy a page with consent, for example when a funder has asked for an anonymised example of progress, but the page is copied only where the learner agrees.

Acceptable Use of the Website

The website is provided for learning about the reading room, making contact and reading the information on the pages. A visitor agrees not to attempt to gain unauthorised access to the site, not to interfere with its operation, and not to use the site in a way that breaks the law.

A visitor agrees not to submit the contact form with another person details without permission, not to send abusive or threatening messages, and not to use the site for automated scraping that burdens the service.

Where a person discovers a security weakness, the desk welcomes a private report to info@haywardliteracyplus.com and asks that the weakness be described without exploiting it or accessing other people information.

Intellectual Property

The design of the website, the text on its pages and the teaching materials produced by the Council belong to HAYWARD LITERACY PLUS COUNCIL. A person may print or save a page for personal and noncommercial use. A person may not republish substantial parts of the site or claim the teaching materials as their own without written permission.

Where the Council uses a text owned by another publisher, the text is used within its licence or within fair use for teaching. A learner who needs a purchased copy of a book will be told before the term begins.

The name HAYWARD LITERACY PLUS COUNCIL, the operating name Hayward Literacy and the reading room marks may not be used in a way that suggests endorsement of another organisation or a commercial product without written permission.

Third Party Links and Materials

The website may link to libraries, partner agencies and reading resources that the Council does not control. A link is offered as a convenience. The Council is not responsible for the content, availability or practices of a linked site and does not endorse everything found there.

Where a partner delivers a portion of a session, the terms of that partner may apply alongside these terms. The desk will say so at the point of referral so that a learner knows whose rules govern which part of the service.

Privacy and Personal Information

Personal information is handled as described in the Privacy Policy, which forms part of these terms. In summary, the Council collects the minimum needed to teach and report, keeps it in a secure place, shares it only where there is a lawful basis, does not sell it, and offers every person the right to see, correct or delete their information.

A learner who does not want a particular piece of information recorded should tell the desk at the placement window so that an alternative can be arranged before the record is created.

Safety and Reporting Concerns

The reading room is supervised by staff during open hours. If a learner feels unsafe while attending a session, or has a concern about the conduct of another person, staff should be told immediately and a written note will be made.

A concern of a serious nature, including an allegation of abuse, will be handled according to the Council safeguarding practice and may be reported to the relevant authority without the consent of the person who raised it where the law requires. The person who raised the concern will be told what happens next as far as the law allows.

Outside open hours the reading room is locked and not available for individual use.

Disclaimer of Educational Outcomes

The Council provides careful, personalised teaching. It cannot promise a particular score, a particular qualification or a particular job outcome, because those outcomes depend on many factors outside the reading room, including time, health and opportunity.

Information on this website is provided in good faith and updated from time to time. Where a page describes a service in general terms, the desk will confirm the specific arrangement before a learner begins. The website is not a contract for a specific result.

Nothing in the reading room constitutes legal, medical, immigration or financial advice. A learner who needs such advice will be referred to a qualified professional where the desk knows of one.

Limitation of Liability

To the extent permitted by law, HAYWARD LITERACY PLUS COUNCIL is not liable for indirect or consequential loss arising from the use of the website or from attendance at the reading room. This includes loss of income, loss of opportunity or distress arising from a service that could not be delivered.

Where liability cannot be excluded, the total liability of the Council for a claim relating to a service is limited to the fees paid for that service, if any. Where a session is free, no sum is payable as damages under this clause.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that the law does not allow to be limited. A learner rights under consumer law remain in full.

Indemnity

A person who uses the website in breach of the acceptable use section agrees to cover any reasonable loss the Council suffers as a direct result, including the cost of repairing a system that was damaged. This clause does not apply to a learner in relation to ordinary attendance at sessions.

Where a partner agency refers a learner and provides information that is inaccurate, the partner agrees to cooperate in correcting the record and to cover the reasonable cost of any correction required by law.

Suspension and Termination

The Council may pause or end a tutoring arrangement where a learner repeatedly threatens or harasses staff or other learners, where the reading room cannot meet a need safely, or where a learner has breached these terms in a way that cannot be resolved by conversation.

Except in an emergency, the desk will explain the decision in writing, allow the learner to respond, and offer to refer the learner to another service. The learner may collect their notebook and return loaned materials at a time arranged with the desk.

A learner may stop attending at any time and does not need to give a reason. The desk will confirm the end of the arrangement in a short message and will explain how the record will be kept or destroyed.

Changes to These Terms

The Council may update these terms to reflect a change in practice, a change in law or a change in the service. The effective date at the top of the page shows when the current version took effect.

A significant change will be announced at the desk, in the next term plan and, where possible, in a short message to learners with an active arrangement. A learner who does not agree with a change may end the arrangement without penalty.

Sessions already scheduled when a change takes effect continue under the terms that were in force when they were booked, unless the change is required by law.

Governing Law and Disputes

These terms are governed by the laws of the State of California and of the United States to the extent they apply. The parties will first try to resolve a dispute by conversation at the desk, then by written exchange with the director of teaching, and then, if necessary, through mediation.

Where a dispute cannot be resolved, the courts located in Alameda County, California, have jurisdiction. Nothing in this section prevents a person from raising a consumer complaint with a public authority.

General Provisions

If any provision of these terms is found to be unenforceable, the rest of the terms continue in force. The unenforceable provision will be read down to the minimum extent needed to make it enforceable.

These terms, together with the privacy policy and the service descriptions, form the whole agreement between a learner and the Council for the reading room service. A failure to insist on a provision on one occasion is not a waiver of it.

A person may not transfer their rights under these terms to another person without the written agreement of the Council. The Council may transfer its obligations only where the new party continues the same service under the same terms.

Headings are for convenience only and do not affect the meaning of the clauses. The terms are written in English, and where a translation is provided for convenience the English version prevails.

How to Reach the Desk

Questions about these terms, requests relating to a service arrangement and any concern about conduct at the reading room should go to the desk.

The reading room thanks every learner, tutor and partner who reads these terms carefully. A person who has read this far already knows more about the service than most visitors, and the desk will always prefer a conversation to a conflict.
